How to make a claim

 

You must notify Peliwica Insurance as soon as practicably possible and complete in writing, by email or over the telephone giving us full details of what has happened.

  • You must provide as soon as practicably possible  (seven (7) days in the case of Damage caused by riot, civil commotion, strikers, locked-out workers, persons taking part in labour disturbances or malicious persons) with:

    • full written details of what has happened and the amount of the Claim;

    • details of any other insurances applicable to the loss being claimed for, whether You intend to make a Claim against such insurances or not and whether such insurances are valid and collectible or not;​

    • You shall at all times co-operate with Us and Our representatives in the investigation and adjustment of any actual or potential Claim by:

      • taking all practicable steps at Your own expense to prevent further losses:

      • for Mortality claims any further accident, injury, illness or disease;

      • for Material Damage claims any further Damage

      • retaining any evidence relating to the Claim until We or Our representatives have had the opportunity to inspect it

      • providing Us or Our representatives with access to copies and originals of such evidence as We may require;        

      • providing any other information We may reasonably require to investigate Your Claim.

 

Enforcement of Rights

We may take any action We consider necessary to enforce Your rights or Our rights under this Certificate of Insurance.

Mortality Claims – things You need to do

  • In the event of any injury, illness, lameness, disease, injury, accident or physical disability whatsoever of or to an Animal You must as soon as practicably possible, at Your own expense employ a Veterinary Surgeon and, if required by Us, allow removal of the Animal for treatment; and

  • In the event of the death or Humane Destruction of any Animal, You shall:

  • at Your own expense as soon as practicably possible arrange for a Veterinary Surgeon to confirm:

  • the identity of the Animal; and

  • the cause of death (or in the case of Humane Destruction, the accident, injury, illness or disease which gave rise to the Humane Destruction). 

If the Veterinary Surgeon is unable to confirm the cause of death or in the case of Humane Destruction  the accident, injury, illness or disease which gave rise to the Humane Destruction we require a Post-Mortem to be carried out.  This will be at Your expense unless You have purchased the Post-Mortem Costs Extension (please check Your Schedule).

  • complete and send to Us as soon as practicably possible the detailed Claim form provided to You by Your Broker.

  • You shall at all times co-operate with Us and Our representatives in the investigation and adjustment of any actual or potential Claim by:

  • providing Us or Our representatives with access to copies and originals of all veterinary records whether held by You or any Veterinary Surgeon;

  • providing full details of the relevant Animal(s) including all information relating to condition, history, performance or value together with any salvage receipts; and

  • retaining any evidence (including the remains of the Animal) relating to the Claim until We or Our representatives have had the opportunity to inspect it.

Our rights when you make a Mortality claim

  • We have the right to instruct a Veterinary Surgeon on Our behalf if necessary.

  • We have the right to have a Post-Mortem carried out by Our Veterinary Surgeon at Our own expense.

  • We have the right to deduct from any Claim payment:

    • any proceeds of  the sale of the Animal’ s remains after receiving permission from Us to remove and dispose of it at your own expense;

    • the value of any semen or embryos in storage which have been collected from the Animal, up to 50% of the Sum Insured for that Animal.

Material Damage Claims – things You need to do

In the event of Damage You must:

  • notify the police authority as soon as practically possible it becomes evident that any Damage has been caused by malicious persons

Liability Claims – things You need to do

You notify Us as soon as practically possible in writing of:

  • any Claim made against any You or any Insured Person which is likely to fall within the scope of this Certificate of Insurance;

  • any circumstances of which You or any Insured Person shall become aware which are likely to give rise to such a Claim being made against You.

 

Trailer Claims - things You need to do

In the event of any accident or loss of or Damage involving the insured Trailer(s),

 

For all Claims

  • You must, as soon as practicably possible, advise Us by telephone, e-mail or fax as specified in the Schedule.

  • You must take all practicable steps to limit any further loss, damage or injury.

  • You must complete and return a claim form which We will supply.

 

For Legal Liability Claims

  • You must not admit liability or offer or agree to settle any claim without Our written permission.

  • You shall give all information and assistance to enable Us to settle or resist any claim or to institute proceeding.

  • You must provide any witness details and assist us in contacting them for statements if required.

  • You must forward to Us (which shall be notice to the insurer) any Third Party correspondence, writ, summons or other legal process issued or commenced against You.

  • We will take full responsibility for conducting, defending or settling any claim in Your name.

  • If liability is accepted for Third Party property damage, You will be required to send Us Your excess.

 

Theft Claims - Things you need to do

  • You must inform the Police as soon as practicably possible following a break in or theft or attempted theft and then assist them with their investigations. You will be required to supply a crime reference and details of the attending Police when You submit Your completed claim form.

  • We recommend that You take photographs of any evidence of the breaking or damage to property that occurred during the break in.

  • You will be required to send in estimates for values for any items stolen, subject to the Sum Insured detailed on the Schedule. You may be required to provide proof of valuation on any items specified in the Schedule that are stolen.

 

Accidental Damage Claims - Things you must do

  • You must submit estimates for the costs of repairs.

  • We reserve the right to either repair, replace or to make a cash settlement.

  • You must not abandon any property to Us without Our written permission.
